{"id":6447,"date":"2018-01-30T09:53:18","date_gmt":"2018-01-30T08:53:18","guid":{"rendered":"https:\/\/www.lauwers-seutin.be\/?p=6447"},"modified":"2018-01-30T09:54:59","modified_gmt":"2018-01-30T08:54:59","slug":"vers-un-retour-la-transaction-penale","status":"publish","type":"post","link":"https:\/\/lauwers-law.be\/fr\/vers-un-retour-la-transaction-penale\/","title":{"rendered":"Vers un retour de la transaction p\u00e9nale"},"content":{"rendered":"<p class=\"cs95e872d0\"><span class=\"cs93c4bd38\">La transaction p\u00e9nale \u00e9tait encore tout r\u00e9cemment \u00e0 la une de l\u2019actualit\u00e9 notamment en raison de l\u2019extension de ce r\u00e9gime par une loi vot\u00e9e en 2011.<\/span><\/p>\n<p class=\"cs95e872d0\"><span class=\"cs93c4bd38\">La transaction p\u00e9nale permet \u00e0 l\u2019auteur pr\u00e9sum\u00e9 d\u2019une infraction p\u00e9nale de ne pas \u00eatre poursuivi moyennant le payement \u00e0 l\u2019Etat d\u2019un certain montant. La transaction p\u00e9nale n\u2019est admise que si \u00ab le fait ne para\u00eet pas \u00eatre de nature \u00e0 devoir \u00eatre puni d&rsquo;un emprisonnement correctionnel principal de plus de deux ans ou d&rsquo;une peine plus lourde, y compris la confiscation le cas \u00e9ch\u00e9ant, et qu&rsquo;il ne comporte pas d&rsquo;atteinte grave \u00e0 l&rsquo;int\u00e9grit\u00e9 physique \u00bb.<\/span><\/p>\n<p class=\"cs95e872d0\"><span class=\"cs93c4bd38\">Ce proc\u00e9d\u00e9 a suscit\u00e9 de nombreuses questions de constitutionnalit\u00e9 qui ont \u00e9t\u00e9 soumises \u00e0 la Cour constitutionnelle. Celle-ci n\u2019a pas manqu\u00e9 de juger que ce dispositif viole les articles 10 et 11 de la Constitution notamment en raison du fait de l\u2019absence de contr\u00f4le juridictionnel satisfaisant quant \u00e0 la proportionnalit\u00e9 de la transaction p\u00e9nale envisag\u00e9e.<\/span><\/p>\n<p class=\"cs95e872d0\"><span class=\"cs93c4bd38\">Un projet de loi a \u00e9t\u00e9 r\u00e9dig\u00e9 par le Gouvernement en vue de corriger les griefs mis en \u00e9vidence par la Cour constitutionnelle. Ainsi, le r\u00f4le du juge dans le cadre de la v\u00e9rification de la proportionnalit\u00e9 de la transaction envisag\u00e9e est consid\u00e9rablement \u00e9tendu. Des balises formelles sont \u00e9galement projet\u00e9es. <\/span><\/p>\n<p class=\"cs95e872d0\"><span class=\"cs93c4bd38\">Nous suivons \u00e9videmment ce dossier de tr\u00e8s pr\u00e8s, notamment
